From the beginning, a code of ethics for bioethicists has been conceived of as part of a movement to professionalise the field. In advocating for such a code, Baker repeatedly identifies ‘having a code of ethics’ with ‘professionalization’. The American Society of Bioethics and Humanities (ASBH) echoes this view in their code of ethics for healthcare ethics consultants (HCECs)1 and the subsequent publication in the American Journal of Bioethics.2 Taking for granted that a code of ethics could be a valuable (...) asset for HCECs, this essay has two aims. First, there are good reasons to doubt that the label ‘profession’ has significant meaning for HCECs. Attempts to accurately conceive of a profession fall into two broad camps: substantive and formal. Substantive conceptions should be rejected. Specifically, substantive conceptions beg the question about what it means to be a profession, which produces devastating problems for practical application. Formal conceptions of profession (eg, Davis’ conception3) avoid begging the question, but do so at the cost of identifying the responsibilities of a profession. Using the term ‘professional responsibilities’, then, requires additional explication and classifying HCECs as professionals requires the identification of their role-specific responsibilities.i Second, this essay will critique the ASBH code of ethics for HCECs as a first articulation of these responsibilities. As written, this code of ethics has limited value for HCECs because most of the responsibilities identified in this code do not identify HCEC-specific responsibilities. In closing, some important strategies to improve upon this initial attempt to define the responsibilities of HCECs are identified. For at least the last decade, Baker has encouraged bioethicists to adopt a code of ethics. My concern here is to motivate some theses in the philosophy of mind concerning the interpersonal character of intentions. I will do so by investigating aspects of shared agency. The main point will be that when acting together with others one must be able to act directly on the intention of another or others in a way that is relevantly similar to the manner in which an agent acts on his or her own intentions. What exactly this means will become (...) clearer once we understand what it is to act directly on one’s own intentions. But I take it to be a fundamental assumption of the prevailing individualism of the theory of action—one at the core of its conception of the separateness of individuals—that one person cannot act directly on another’s intention. I agree that there is an important way in which we are or can be separate and autonomous thinkers and agents. But the way the individualist tries to capture this separateness is misguided. (shrink)

This text proposes an interpretation of the work of Franklin Leopoldo e Silva based on the reading of some of his numerous published articles and books, without neglecting the classes and guidance received from the stage of Scientific Initiation to Postdoctoral studies. Precisely, by highlighting the importance of three thinkers widely studied by Professor Franklin – Berkeley, Bergson and William James –, we suggest that at the heart of this philosophical experience there would be a constant: empiricism. Instead, spatiality has a special meaning with regard to pain. By defining pain in phenomenological terms (...) as a disturbed form of bodily perception, I contend that the “in” in “pain in my body” has a dual spatial meaning: firstly, it signifies my internal perceptual relation to a disturbing part of my body; secondly, it denotes the external perceptual relation to my environment that the disturbance forces me to take. Once the spatiality of pain is understood in terms of such a perceptual relation, it is not restricted to localisable hurts, but pertains to all forms of pain, such as affliction and agony. In this volume, a distinguished philosopher and moral rights theorist examines important changes that have occurred in our thinking about rights since first mention of them was made in early modern times. His inquiry is framed by an opening question and a concluding response. The question is whether the Greeks had any conception of a moral right. Some argue that they did not, on the ground that they had no word for a right. Others claim that they did, since they (...) employed certain locutions, the equivalents of which in our language are tied to some notion of a moral right. Professor Melden reviews in detail some of the most important historical conceptions of rights and examines serious questions raised by the fact that there have been striking changes in our thinking about rights. His discussion elucidates the place of moral rights in the broader network of moral concepts, along with the role they should play in our moral lives. Among the fundamental issues raised and discussed are those concerning the ways in which we are to understand various sorts of rights, the relation of special moral rights to our basic human rights, the now familiar claim that there are animal rights, the nature of moral progress, and the dream of a moral science. We motivate and introduce a new method of abduction, Matrix Abduction, and apply it to modelling the use of non-deductive inferences in the Talmud such as Analogy and the rule of Argumentum A Fortiori. Given a matrix $${\mathbb {A}}$$ with entries in {0, 1}, we allow for one or more blank squares in the matrix, say a i,j =?. The method allows us to decide whether to declare a i,j = 0 or a i,j = 1 or a i,j =? (...) undecided. This algorithmic method is then applied to modelling several legal and practical reasoning situations including the Talmudic rule of Kal-Vachomer. We add an Appendix showing that this new rule of Matrix Abduction, arising from the Talmud, can also be applied to the analysis of paradoxes in voting and judgement aggregation. This paper explores the work of Nicolas Rashevsky, a Russian émigré theoretical physicist who developed a program in "mathematical biophysics" at the University of Chicago during the 1930s. Stressing the complexity of many biological phenomena, Rashevsky argued that the methods of theoretical physics -- namely mathematics -- were needed to "simplify" complex biological processes such as cell division and nerve conduction. A maverick of sorts, Rashevsky was a conspicuous figure in the biological community during the 1930s and early 1940s: he (...) participated in several Cold Spring Harbor symposia and received several years of funding from the Rockefeller Foundation. However, in contrast to many other physicists who moved into biology, Rashevsky's work was almost entirely theoretical, and he eventually faced resistance to his mathematical methods. Through an examination of the conceptual, institutional, and scientific context of Rashevsky's work, this paper seeks to understand some of the reasons behind this resistance. (shrink)

This paper addresses two issues. The first part deals with the classic question of human nature by focussing on the problem of human consciousness, in particular, the relationship between subjective and intentional consciousness. I argue for an essential link between subjectivity and intentionality by suggesting a phenomenological conception of the human condition. On this basis, the second part deals with what I call ‘humane’ ethics. This part shows that my conception of the human condition contains a humane approach to morality.

This article examines how scientists and regulators distribute the benefit of the doubt about drug safety under conditions of scientific uncertainty. The focus of the empirical research is the regulatory controversy over the hepatorenal toxicity of benoxaprofen in the United Kingdom and the United States. By scrutinizing the technical coherence of the arguments put forward by industrial and government scientists, it is concluded that these scientists are willing to award the commercial interests of the pharmaceutical industry an enormous benefit of (...) the sccentific doubt, which is not consistent with the best interests of patients. Interpretative flexibility, the burden of proof falling on regulators and their trust in, and dependence on, industrial scientists facilitates that distribution of the benefit of the scientific doubt. However, regulatory authorities' need for viability and the rationality common to opposing scientific views suggest that it is possible, in principle, to alter this dominant trend. To achieve adequate patient protection, drug regulation in the United Kingdom and the United States requires extensive reform. Some preliminary policy changes are sketched. (shrink)

The obscured Thomas precessionof the special theory of relativity (STR) has been soared into prominence by exposing the mathematical structure, called a gyrogroup,to which it gives rise [A. A. Ungar, Amer. J. Phys.59,824 (1991)], and the role that it plays in the study of Lorentz groups [A. A. Ungar, Amer. J. Phys.60,815 (1992); A. A. Ungar, J. Math. Phys.35,1408 (1994); A. A. Ungar, J. Math. Phys.35,1881 (1994)]. Thomas gyrationresults from the abstraction of Thomas precession.As such, its study sheds light on (...) relativistic velocity spaces and their symmetries which are concealed in Thomas precession. In order to uncover new properties of relativistic gyrogroups, we employ in this article the group theoretic concepts of divisible groupsand two-torsion free groupsto construct midpointsin gyrogroups. Systems of successive midpoints then describe straight gyrolinesand suggest a new, natural distance function that involves a Thomas gyration. These, in turn, reveal a new, interesting geometry that underlies relativistic velocity spaces. In this resulting gyrogeometrythe straight gyrolines form geodesics under a distance function which turns out to be the Poincaré hyperbolic distance function relaxed by a Thomas gyration. These geodesics do obey the parallel axiom of Euclidean geometry. Ironically, (i) attempts to understand the parallel postulate of Euclidean geometry gave rise to hyperbolic geometry in which the parallel postulate disappears;(ii) hyperbolic geometry gave rise to Einstein's STR; (iii) Einstein's STR established the bizarre and counterintuitive relativistic effect called Thomas precession, the abstraction of which is called Thomas gyration; and (iv) Thomas gyration now repairs in this article the Poincaré distance function of hyperbolic geometry to the point where the parallel postulate reappears. Construal-level theory emphasizes that representing events at greater spatial, temporal, social, or hypothetical distance results in processing information at high construal levels (more conceptual, abstract). We posit that psychological distance and construal level are somewhat separable constructs, and can have different effects on emotion, and therefore, emotion regulation. We argue that psychological distance influences emotional appraisal, such that increasing distance results in lower emotion intensity, which can be leveraged to down-regulate emotions. However, we consider construal level a mindset, which can (...) occur with either high or low psychological distance. Furthermore, we argue that compared with psychological distance, construal level has a more nuanced relationship with emotion, and changing construal level for the purpose of changing emotion also requires considering the construal level of one's emotion-regulation goals. ABSTRACT:Biomedical and philosophical traditions postulate the experience of pain either as quantifiable or as sociocultural phenomena. This critical assessment offers a close reading of Lara Parker’s Vagina Problems: Endometriosis, Painful Sex, and Other Taboo Topics (2020) and Abby Norman’s Ask Me About My Uterus: A Quest to Make Doctors Believe in Women’s Pain (2018), analyzing the authors’ use of language as a tool to comprehend and communicate pain. Norman’s and Parker’s memoirs narrate the lived experience of endometriosis, a condition diagnosed (...) almost exclusively in women and characterized by chronic pain. The essay looks at how metaphors are employed in living and narrating endometriosis in medical, social, and cultural settings that are highly skeptical of women’s pain and trace a shift in the use of pain metaphors towards an acceptance of the pain experience, which is conceptualized as empowering by the climax of the narrative. ABSTRACT Dance requires optimal range-of-motion and cognitive abilities. Mental imagery is a recommended, yet under-researched, training method for enhancing both of these. This study investigated the effect of Dynamic Neuro-Cognitive Imagery (DNI™) training on developpé performance (measured by gesturing ankle height and self-reported observations) and kinematics (measured by hip and pelvic range-of-motion), as well as on dance imagery abilities. Thirty-four university-level dance students (M age = 19.70 + 1.57) were measured performing three developpé tasks (i.e., 4 repetitions, 8 consecutive seconds (...) hold, and single repetition) at three time-points (2 x pre-, 1 x post-intervention). Data were collected using three-dimensional motion capture, mental imagery questionnaires, and subjective reports. Following the DNI™ intervention, significant increases (p <.01) were detected in gesturing ankle height, as well as in hip flexion and abduction range-of-motion, without significant changes in pelvic alignment. These gains were accompanied by self-reported decrease (p <.05) in level of difficulty experienced and significant improvements in kinesthetic (p <.05) and dance (p <.01) imagery abilities. This study provides evidence for the motor and non-motor benefits of DNI™ training in university-level dance students. (shrink)
